Brazil Bill 3058/26 proposes rights for domestic workers after employer death
Bill 3058/26 is currently under analysis in the Brazilian Chamber of Deputies. The proposed legislation seeks to amend the Domestic Workers Law (Complementary Law 150/15) to clarify rights in the event of an employer's death.
Under the proposal, the death of an employer would automatically terminate the domestic employment contract. This would guarantee the worker access to severance pay, including the 3.2% monthly FGTS compensation indemnity, indemnified notice, and unemployment insurance benefits.
The bill provides an exception for cases of employer succession. If the family continues to reside in the same home and the worker remains in their position, the contract is not terminated; instead, the new employer must simply update the worker's records in the eSocial system and labor booklet.
Author of the bill, Deputy Laura Carneiro (PSD-RJ), stated that the current legal ambiguity leads to conflicting court decisions. She argued the measure is necessary to prevent abrupt, involuntary unemployment and provide immediate support for workers to find new employment.
