Brazil Bill proposes criminalizing suicide inducement in domestic violence cases

Proposed Bill 2493/26 in Brazil aims to criminalize inducing, instigating, or assisting the suicide or self-mutilation of women in cases of domestic violence. Authored by Deputy Maria do Rosário, the legislation seeks to amend the Penal Code to address psychological violence that leads to mental collapse.

The bill establishes a prison sentence of 2 to 6 years for initial conduct. If the act results in self-mutilation, attempted suicide, or serious bodily injury, the penalty increases to 5 to 10 years. In cases resulting in death, the crime would be classified as ‘feminicide suicide,’ carrying a sentence of 12 to 30 years. Penalties may double if the crime involves futile motives, violation of protective orders, or tampering with the crime scene.

Additionally, the proposal modifies the Code of Criminal Procedure to mandate stricter investigation protocols for violent deaths of women. This includes the preservation of digital evidence, testimony collection from social circles, and the requirement of a psychological autopsy report. Investigations cannot be closed without these steps and prior notification to the victim's family.
