Brazil Bill proposes reintegration measures for workers returning from maternity leave

A new legislative proposal, Bill 2307/26, is under review by the Brazilian Chamber of Deputies to establish reintegration programs for female employees returning from maternity leave. The bill would require companies with 20 or more employees to implement welcoming measures to prevent dismissals following the leave period.

Key provisions include a mandatory alignment interview upon return to define tasks and update the employee on organizational changes. The proposal also mandates the preservation of the worker's previous position, function, and contracted workload, unless changes are requested by the employee, recommended by a doctor, or settled through collective bargaining.

Authored by Deputy Denise Pessôa, the bill seeks to amend the Consolidation of Labor Laws (CLT) and Law 9.029/95 to explicitly include maternity as a protected category against discriminatory practices. The measure aims to extend job security beyond the current five-month provisional stability period. The bill will undergo analysis by the committees on Labor, Women's Rights, and Constitution and Justice before proceeding to the Senate.
