Brazil businesses face challenges from end of 6x1 work schedule

Brazilian business entities are preparing for significant labor transitions following the implementation of Constitutional Amendment No. 141/2026. The amendment mandates a reduction in the maximum weekly workload from 44 to 42 hours, with a further reduction to 40 hours scheduled for the following year. This change effectively ends the regular 6x1 work scale, requiring companies to reorganize shifts and staffing.

The National Confederation of Trade in Goods, Services and Tourism (CNC) has raised concerns regarding the short adaptation period, noting that the first stage of the reduction begins on December 16, 2026. The CNC has filed a Direct Action of Unconstitutionality (ADI 8041) with the Supreme Federal Court (STF) to challenge specific provisions of the amendment.

Industry representatives, including FecomercioSP, emphasize that collective bargaining will be a critical tool for managing these changes. Negotiations will be essential to determine how companies handle weekly rest days, as the new law does not guarantee that the two mandatory days off will be consecutive. Discussions are also focusing on the impact of these changes on micro and small enterprises, as well as the maintenance of commerce operations on weekends and holidays.
