Brazil clarifies legal treatment of so‑called “crime passional”

Brazilian law does not recognize “crime passional” as a distinct legal category. Such offenses are prosecuted as homicide, either simple or qualified, with the motive examined during trial. If jealousy is judged as a selfish or vengeful motive, it can be classified as a “motivo torpe” or “motivo fútil” under Article 121, § 2 of the Penal Code, raising the penalty to 12–30 years of imprisonment. Conversely, when the act is committed under “violent emotion” following an unjust provocation, Article 121, § 1 allows a reduction of the sentence by one‑sixth to one‑third.

Many cases popularly labeled as passion crimes are actually femicides. Under Law 13.104/15, femicide is a qualified homicide with a penalty of 20–40 years, treated as a heinous crime with stricter rules on parole and regime progression.
