Brazil sanctions laws creating new judicial and institutional funds
President Luiz Inácio Lula da Silva has sanctioned three significant laws aimed at restructuring and financing key Brazilian judicial institutions through the creation of new funds.
Law 15.498 updates judicial costs for the Federal Justice and the Superior Court of Justice (STJ). It establishes the Fejufe and FESTJ funds to support modernization. New cost tables for the Federal Justice are set to take effect on January 1, 2027, with annual adjustments based on the IPCA. The law also includes provisions for legal aid, presuming those earning up to R$ 5,000 per month are eligible for cost exemptions.
Law 15.499 creates the Fundo de Fortalecimento da Cidadania e Aperfeiçoamento do Ministério Público da União (FMPU). This fund is intended for institutional projects, infrastructure, equipment, and training. However, the President applied partial vetoes to several revenue sources, including donations, public exam fees, and transfers from other funds, to comply with budgetary rules and maintain institutional autonomy. The use of FMPU resources for personnel or indemnity expenses is strictly prohibited.
Law 15.500 establishes the Fundo de Fortalecimento do Acesso à Justiça, Promoção dos Direitos Fundamentais e Estruturação da Defensoria Pública da União (DPU). This fund aims to bolster the DPU’s ability to provide free legal defense for those in need. Similar to the MPU fund, it prohibits spending on personnel and indemnity payments. The President also vetoed certain revenue streams for the DPU, such as civil fines and donations, citing unconstitutionality and public interest concerns.
