Brazil ends 6x1 work schedule via Constitutional Amendment

The Brazilian National Congress has promulgated Constitutional Amendment No. 141 of 2026, officially ending the 6x1 work schedule. The new legislation transitions workers to a 5x2 model, guaranteeing two days of weekly rest.

The amendment mandates a gradual reduction of the maximum weekly workload from 44 to 40 hours without any reduction in worker salaries. The transition will occur in stages: the first reduction to 42 hours will take effect 60 days after promulgation, with the full reduction to 40 hours occurring 14 months later.

While the measure is celebrated by labor advocates for improving quality of life, industry groups like FIEMG have expressed concerns regarding increased labor costs and potential impacts on business competitiveness. To mitigate effects on micro-entrepreneurs, the amendment includes provisions to increase the annual revenue limit for MEIs and allows them to hire up to two employees.
