Brazil considers mandatory reintegration for workers returning from maternity leave
A new bill, PL 2307/26, is under review by the Brazilian Chamber of Deputies that would require companies with 20 or more employees to implement reintegration programs for workers returning from maternity leave.
The proposal aims to combat post-leave dismissals and ensure job stability by mandating alignment interviews to define tasks and update employees on organizational changes. It also requires the preservation of the employee's previous role, function, and contracted workload, unless changes are requested by the employee, recommended by a doctor, or negotiated through collective bargaining.
Author Deputy Denise Pessôa stated that current provisional stability of five months is insufficient to maintain employment for mothers. The bill seeks to amend the Consolidation of Labor Laws (CLT) to explicitly include maternity as a protected category against discriminatory practices.
