Brazil considers new traffic laws for electronic fines and liability

Two legislative proposals are currently moving through the Brazilian Congress that aim to modify the Brazilian Traffic Code (CTB).

Bill 2975/2026, authored by Deputy Gleisi Hoffmann, proposes making countdown timers mandatory for traffic lights equipped with electronic enforcement. Under this rule, the validity of electronic fines for speeding or running red lights would be contingent upon the presence of a visible, synchronized, and functional countdown display. The proposal seeks to increase driver predictability and reduce risky maneuvers, with technical specifications to be determined by the National Traffic Council.

Separately, Bill 5733/2023, authored by Deputy Helena Lima, proposes changing how traffic infractions are linked to vehicles. The bill suggests that in specific cases—such as rental vehicles, or when an infraction is the responsibility of a transporter rather than the owner—the fine could be decoupled from the vehicle itself. In these instances, notifications and collection procedures would be directed to the specific individual or legal entity responsible for the violation rather than remaining tied to the vehicle's registration.
