Brazil court annuls penalties in Dilma Rousseff impeachment fiscal case

A Federal Court decision has annulled the penalties imposed by the Federal Court of Accounts (TCU) on former National Treasury Secretary Arno Augustin regarding the “fiscal pedaling” (pedaladas fiscais) case. This ruling marks a significant development ten years after the impeachment of former President Dilma Rousseff.

The court determined that the TCU punished Augustin based on an interpretation adopted only in 2015, applying it retroactively to events that occurred prior to that change. Previously, delays in federal transfers to public banks were not considered prohibited credit operations under the Fiscal Responsibility Law. Furthermore, Augustin’s actions were supported by understandings from the Office of the Attorney General of the Union and the Office of the Prosecutor General of the National Treasury.

This decision follows a similar annulment previously obtained by former Finance Minister Guido Mantega, potentially undermining the legal foundations used to justify the impeachment process.
