Brazil court authorizes child's image use for fashion campaign

A court in Itapoá, Brazil, has authorized a clothing company to use the image, voice, and name of a child model for a fashion campaign for a maximum period of 12 months. The decision by the 1st Court of the Itapoá district was limited to content from a single audiovisual and photographic session conducted with a legal guardian present. The judge noted the activity was a one-time event of low complexity, performed during school holidays, with no evidence of eroticization, adultization, or harm to the child's physical or psychological development.

This ruling occurs amidst broader discussions regarding the 'ECA Digital' (Law No. 15.211/2025), which expanded protections for children and adolescents in digital environments. While parents do not need judicial authorization for routine personal posts, the law requires prior judicial authorization when a child's image or routine is habitually exploited in monetized or boosted content. Legal experts emphasize that children are subjects of rights, meaning their privacy and image belong to them rather than being the property of their guardians.
