Brazil court rules Union cannot withhold goods over tax classification disputes

The Brazilian Federal Regional Court of the 1st Region (TRF-1) ruled that the Union cannot withhold imported goods to force the payment of tax differences when a taxpayer has filed an administrative challenge. The court maintained a lower court decision requiring the release of goods and the reimbursement of procedural expenses to the importer.

The case arose after customs officials identified a tax classification error and detained merchandise, conditioning its release on the payment of disputed taxes. While the Union argued that Supreme Court precedent (Theme 1.042) allows conditioning customs clearance on tax payment, the importer successfully argued that an administrative challenge suspends the tax credit's enforceability under Article 151 of the National Tax Code.

Technical tax classification requires a rigorous analysis of a product's composition, manufacturing process, and function to determine the correct NCM (Mercosul Common Nomenclature) code. Experts note that classification must follow Harmonized System rules rather than relying on commercial names or the practices of competitors, as minor differences in material or application can lead to different tax obligations.
