Brazil court suspends new glyphosate herbicide registrations for 90 days

A labor court in Brasília has ordered a 90-day temporary suspension of all new registrations and authorizations for herbicides based on glyphosate and its derivatives. The ruling, issued by Judge Gustavo Carvalho Chehab, also extends to new products deemed identical through phytosanitary extension or equivalence.

The decision follows a request by the Labor Public Ministry to completely ban the production, import, export, and sale of glyphosate-based products. However, the judge denied the request for a total ban, noting that Anvisa’s decision to maintain the active ingredient carries a presumption of legality that has not been refuted by contrary evidence.

The court identified a risk of harm due to the pending re-analysis of these substances under Law No. 14,785/2023, noting that the deadline for such reviews has expired without the Union providing technical justifications for the delay. Anvisa has been given 20 days to address potential discrepancies in product labeling.
