Brazil courts order health insurers to fund surgeries and therapy
A judge of the 4ª Vara Cível da Comarca de Mossoró (RN) ordered a health insurance company to authorize and fully pay for a necessary intestinal surgery for a child suffering severe pain and anal lesions, also imposing a R$ 5,000 moral‑damage award for the delay.
The 9ª Câmara Cível of the Tribunal de Justiça do Paraná affirmed that daily fines for a health plan’s failure to provide prescribed home occupational therapy may be accumulated for each period of non‑compliance, rejecting a lower‑court limitation and confirming the insurer’s ongoing obligation to the patient.
