Brazil courts rule in favor of indigenous land and environmental rights

In Brazil, two separate legal rulings have addressed rights and environmental protections for indigenous communities.

A judge in Pernambuco suspended a repossession order that threatened the Kapinawá people in the Aldeia Igrejinha. The decision, issued by Judge Daniel Luís de Oliveira, prohibits the removal of families or the destruction of property and crops. The suspension follows reports from the State Public Defender's Office that the area in question overlaps with traditional indigenous territory and that the families involved were not part of the original legal proceedings.

In Maranhão, the Federal Court condemned the City Hall of Viana for maintaining an open-air landfill within the Taquaritiua Indigenous Territory for over 12 years. The ruling, initiated by the Federal Public Ministry, mandates the permanent closure of the site, environmental recovery, and the creation of a municipal solid waste management policy. While leaders of the Akroá Gamella people described the decision as a victory against environmental racism, they noted that the waste and its health impacts remain in the territory.
