Brazil debates homeschooling rights and child protection
Debates regarding homeschooling in Brazil are highlighting the tension between parental educational freedom and the rights of children to social interaction and protection within the school system.
Carlos Vinícius Reis, president of the National Association of Home Education, argues that homeschooling allows for personalized learning and represents educational liberty. He maintains that the practice should be regulated and supervised by the state to ensure responsibility. He noted that while a 2018 Supreme Federal Court decision recognized the compatibility of homeschooling with the Constitution, specific legislation is still required to establish rules.
Conversely, Ariel de Castro Alves of the Brazilian Bar Association emphasizes that child education is not the exclusive decision of parents. He argues that under the Constitution and the Statute of the Child and Adolescent, the family, the State, and society share a collective obligation to ensure the protection and formation of minors, with schools serving a vital role in identifying potential abuses.
