Brazil: Digital marketing strategies and child protection regulations
Small businesses and entrepreneurs are increasingly utilizing digital marketing strategies, such as influencer partnerships, gamification, and social media engagement, to increase brand visibility. However, these growth strategies may trigger legal responsibilities regarding the protection of minors in digital environments.
Under the Digital ECA (Statute of the Child and Adolescent), companies must consider whether their marketing tactics, such as interactive content or reward systems, inadvertently attract children and adolescents. In October 2026, the National Data Protection Authority (ANPD) published a guiding document to clarify which information technology products and services are subject to these regulations and the specific responsibilities businesses must observe.
