Brazil election poll workers entitled to compensatory time off
Under the Brazilian Elections Law (Law No. 9,504/1997), poll workers and individuals summoned to assist the Electoral Justice are entitled to compensatory time off. For every day of service provided, workers receive two days of rest without any reduction in salary or loss of labor rights.
This benefit applies to both private sector employees and public servants who held a professional bond at the time of their summons. The entitlement includes official training sessions; for instance, completing a training session counts as one day of service, which translates to two days of leave. If a worker completes training and serves during both election rounds, they would accumulate six days of rest.
The specific dates for these days off are to be determined through agreement between the employee and the employer. To claim the benefit, workers must present a declaration of participation issued by the Electoral Justice. Additionally, poll workers may be eligible for food allowances on voting days and may use their experience as a tie-breaking criterion in certain public service examinations.
