Brazil sanctions new protocol for victims of physical and sexual violence
Brazil has sanctioned Law 15.516, which establishes the Intersectoral Protocol for Integrated Care and Response in Situations of Violence. This legislation aims to standardize and humanize the treatment of women, children, adolescents, and vulnerable individuals who are victims of physical and sexual violence.
The new protocol mandates that the first contact be made by public security professionals, who must record the occurrence and ensure the victim is immediately referred to a public health unit. To prevent revictimization, the law requires specific and periodic training for both health and security professionals. Additionally, police and health units must provide reserved rooms for multidisciplinary and confidential care.
Regarding forensic procedures, the law requires that forensic reports be completed and sent to police authorities within ten calendar days. In locations lacking official criminal forensic bodies, examinations may be conducted by a non-official expert appointed by the competent authority. The law also stipulates that if a victim is unable to travel, the forensic expert must travel to them. In cases involving minors, the Council of Guardians must be notified. Failure to comply with these protocols in a way that causes revictimization or harms investigations may be classified as institutional violence under the Abuse of Authority Law.
