Brazil evaluates blocking USA Rare Earth deal for Serra Verde minerals

The Brazilian government is considering measures to block or revise an agreement between the American company USA Rare Earth and the miner Serra Verde. The deal involves the acquisition of a stake in Serra Verde, which operates Brazil’s only commercial rare earth mine in Minaçu, Goiás.

A primary point of contention for the Lula administration is a provision in the contract stating that 100% of the initial production of specific magnetic minerals will be sent to the United States. Brazilian officials argue that since these minerals are located in the subsoil, they constitute national patrimony and should be subject to new regulatory frameworks that prioritize domestic industrialization and value addition.

The government is pushing for the approval of a National Policy for Critical Minerals, which has passed the Chamber of Deputies and is awaiting a vote in the Senate. This legislation includes the creation of the National Council for Industrialization of Critical and Strategic Minerals (CIMCE). If the legislative process is delayed, the government may seek judicial intervention to protect national sovereignty over these strategic resources.
