Brazil implements digital protections for children via ECA Digital

The Brazilian government has begun implementing the Digital Statute of the Child and Adolescent (ECA Digital), established by Law 15.211/2025, to enhance online safety for minors. As part of this regulatory rollout, the Ministry of Justice and Public Security is utilizing age rating classifications to regulate digital platforms. Unlike traditional ratings based solely on content, these new assessments consider business models and interactive features, such as in-app purchases, microtransactions, and mechanisms that encourage excessive use.

To provide legal clarity, the National Data Protection Authority (ANPD) has released a guidance document identifying which entities are considered “suppliers” under the law. This includes social networks, messaging services, gaming platforms, app stores, and e-commerce sites. The ANPD aims to clarify the scope of the law and its obligations for these providers, while the Federal Court of Accounts (TCU) is monitoring the implementation of public policies and the effectiveness of institutional coordination to mitigate digital risks for young users.
