Brazil expands NR‑1 labor rule to treat toxic bosses as occupational risk

Brazil's Ministry of Labor and Employment issued a revised NR‑1 regulation that took effect on 26 May. The rule adds toxic managerial behaviour—such as over‑work, harassment and abusive supervision—to the mandatory Program of Risk Management, treating it like physical or chemical hazards.

Companies have a 90‑day advisory inspection window that ends at the end of August, during which labour inspectors will focus on visits and guidance. Firms must identify, document and control leadership‑induced stress as an occupational risk, with non‑compliance potentially forming evidence in court.

A Harris Poll of American workers in 2026 cited in the announcement found that six in ten report a toxic boss; 47 % said it increased stress or burnout, 35 % lost bonuses, 53 % changed jobs, and 61 % plan to leave if possible. The regulation aims to curb high turnover, absenteeism and productivity losses, citing cases of companies with over 50 % annual turnover and daily 25+ mental‑health‑related absences.

Dr. Marco Aurélio Bussacarini, occupational‑medicine specialist, said, “The employee does not experience the company through institutional discourse, but through the actions of direct leadership…predictability, recognition and clarity or pressure, insecurity and emotional wear.”
