Brazil Federal Court mandates water supply for indigenous communities

The Federal Court of Campo Grande has ordered the Brazilian Union to ensure the continuous supply of treated, potable water to indigenous communities across 19 municipalities in Mato Grosso do Sul. The ruling, resulting from a 2021 civil public action by the Federal Public Ministry, mandates a minimum daily supply of 110 liters of water per person.

The decision requires the Union to collaborate with the Government of Mato Grosso do Sul and local municipal administrations to implement permanent infrastructure. This includes the construction of reservoirs, distribution networks, and household connections. Additionally, the court ordered bimonthly maintenance of these systems to prevent service interruptions due to lack of conservation.

Authorities have 90 days to implement these measures, starting with an identification process of communities currently lacking adequate access. Failure to comply with the court's orders will result in a daily fine of R$ 5,000.
