Brazil implements new restrictions on parliamentary amendment funds
New regulations have been established for civil society organizations receiving funds from parliamentary amendments in Brazil. Following a Supreme Federal Court (STF) decision in January 2026, the Ministry of Management and Innovation in Public Services detailed rules to prevent nepotism and conflicts of interest.
The restrictions prohibit the allocation of funds to third-sector organizations if their leadership or administrative boards include spouses, partners, or relatives up to the third degree of the lawmaker responsible for the amendment or their parliamentary advisors. This prohibition also extends to NGOs that contract or intermediate services for individuals or entities linked to these agents when they are the final beneficiaries of the public funds.
The Attorney General's Office (AGU) is currently reviewing standardized cooperation agreements to include mandatory declarations for compliance. These measures follow audits by the Office of the Comptroller General (CGU), which has already finalized technical reports for several audited organizations to ensure transparency and traceability of public resources.
