Brazil sanctions Prospera MEI law and launches Desenrola 3.0

President Luiz Inácio Lula da Silva has sanctioned Complementary Law No. 238/2026, establishing the 'Prospera MEI' program. The legislation provides full forgiveness of federal tax debts for Microentrepreneurs (MEIs) incurred up to October 13, 2026. This measure, effective January 1, 2027, is expected to benefit approximately 3.6 million entrepreneurs and covers unpaid social security contributions, fines, and interest.

The law also introduces structural changes to the MEI regime, including a progressive increase in the annual revenue limit from R$ 81,000 to R$ 110,000 in 2027, and R$ 140,000 in 2028. Additionally, MEIs will now be permitted to hire up to two employees instead of one.

Simultaneously, the Ministry of Finance has initiated the third phase of the 'Desenrola' program. Finance Minister Dario Durigan announced a call for financial institutions to present up to R$ 90 billion in old debts for potential purchase by the Union. The government aims to hold auctions in November or December, with a projected maximum expenditure of R$ 9 billion due to a mandatory minimum 90% discount on the nominal value of the debts.
