Brazil enacts new rules to combat telephone scams and abusive calls

The Brazilian government has enacted Provisional Measure No. 1.396/2026 to combat telephone fraud, scams, and abusive calling practices. The measure mandates that telecommunications operators implement a three-step digital authentication process for calls. This process requires the originating operator to authenticate the call, intermediate providers to preserve that authentication, and the destination operator to verify its validity before the call is completed.

Under the new rules, calls that fail authentication may be blocked. Additionally, authenticated commercial calls must display the company's name and logo on the recipient's device to increase transparency. To support these measures, a centralized national database of telephone numbers and their owners will be created under the supervision of the National Telecommunications Agency (Anatel).

To curb abusive usage, operators are required to suspend the calling capabilities of users for 15 days if they exceed specific thresholds: making more than 1,000 calls per access or 10,000 total calls in a single day, provided that at least 85% of those calls are short-duration. Anatel has been granted 60 days to regulate the technical procedures and specific implementation rules for these new requirements.
