Brazil labor court affirms employment stability rights after workplace accidents

In Brazil, a regional labor court ruling has reinforced the rights of workers regarding employment stability following workplace accidents. The 6th Chamber of the Regional Labor Court of the 4th Region (RS) overturned a previous decision involving a retired materials controller who suffered a traumatic brain injury after an accident with a forklift.

Despite being already retired through the INSS, the worker was entitled to provisional job stability after a 60-day medical leave. The court ruled that the employee is entitled to substitute indemnity covering the 12-month period of stability following his return to work. This decision clarifies that retirement status does not negate the right to accident-related employment guarantees.

General labor legislation in Brazil defines workplace accidents as incidents related to professional activities that cause injury, functional disturbance, death, or loss of work capacity. This includes typical accidents, occupational diseases, and commuting accidents. Key documentation, such as the Communication of Work Accident (CAT), is essential for establishing legal rights and proving the causal link between the work environment and the injury.
