Brazil labor laws outline vacation and domestic worker rights
Brazilian labor legislation, primarily governed by the Consolidation of Labor Laws (CLT) and Complementary Law No. 150/2015, establishes specific rights for general and domestic workers regarding rest and compensation.
Under the CLT, employees are entitled to 30 days of vacation after 12 months of service. This period must be paid with a one-third salary bonus, and payment should be processed up to two days before the vacation begins. Employers have the authority to determine the vacation period, though they must consider the worker's convenience.
For domestic workers—defined as those providing continuous, subordinate, and paid services in a residential setting for more than two days per week—specific protections apply. These include a maximum 44-hour work week, overtime pay with at least a 50% premium, and mandatory weekly rest periods. Domestic workers also share the right to 30 days of paid vacation with a one-third bonus after every 12 months of employment.
