Brazil legal guidelines for socio-affective paternity recognition

In Brazil, socio-affective paternity—the recognition of a public and lasting filial bond based on care and family relationships—can be processed through civil registries under specific National Council of Justice (CNJ) guidelines. This extrajudicial procedure requires documentation, identification, and proof of the bond, and is limited to recognizing a single socio-affective ascendant.

Certain circumstances require judicial intervention rather than registry processing. These include cases involving disagreements, lack of consent, suspicion of fraud, or requests to include more than one ascendant. Notably, grandparents are prohibited from using this extrajudicial route to recognize grandchildren as socio-affective children.

To prepare for the process, individuals should gather evidence of coexistence and care, such as contracts, receipts, school records, photos, and messages, while ensuring existing legal links are not omitted or altered.
