Brazil: Legal requirements for proving stable unions and managing estates
In Brazil, individuals living in a stable union (união estável) must provide specific evidence to secure pension benefits from the INSS or participate in inheritance processes following a partner's death. While formalizing a union through a public deed is recommended to reduce legal uncertainty, the law recognizes de facto families based on public, continuous, and lasting coexistence with the intent to form a family.
To claim a death pension, the INSS typically requires at least two contemporary pieces of material evidence, with at least one produced within the 24 months preceding the death. Valid documentation includes joint bank accounts, rental contracts, shared expenses, health insurance dependency, or the existence of common children. Witnesses may complement these documents but are generally insufficient on their own.
Regarding estate management, the death of a taxpayer does not automatically terminate fiscal obligations. An executor (inventariante) is responsible for representing the estate (espólio) and must file initial and intermediate income tax declarations until the inventory process is concluded. A final declaration is required once the inventory is finalized through judicial decision or public deed.
