Brazil: Legal rights and protections for citizens aged 60 and older
Under the Brazilian Statute of the Elderly, individuals aged 60 and over gain specific legal protections and rights. Regarding criminal law, Article 183 of the Penal Code stipulates that certain exemptions from punishment and requirements for formal representation in family-related crimes no longer apply when the victim is 60 or older. This change is designed to combat patrimonial violence, which often occurs within domestic settings involving family members such as children, grandchildren, or spouses who manage the victim's finances.
In addition to criminal protections, reaching age 60 grants access to various social benefits. These include priority service in public and private establishments, such as banks, and a minimum 50% discount on tickets for cultural, artistic, and sporting events. For interstate travel, individuals with an income of up to two minimum wages are entitled to two free seats per vehicle; if these are unavailable, a minimum 50% discount on fares is required. While national free urban transport is guaranteed at age 65, specific municipal rules apply to those between 60 and 64.
