Brazil Ministry of Labor issues guidance on quota law for specific diagnoses
The Brazilian Ministry of Labor and Employment (MTE) has clarified that a diagnosis of type 1 diabetes or Tourette syndrome does not automatically guarantee inclusion in job vacancies reserved under the Quota Law.
According to technical guidelines SIT 24/2026 and 25/2026, an individualized assessment is required to determine eligibility. This process must look beyond the clinical diagnosis to evaluate long-term impairments, significant limitations in performing activities, and social barriers faced by the individual.
The goal of these guidelines is to ensure that the legal characterization of a disability is based on evidence of functional impact rather than just a medical name. This approach aims to standardize evaluations by MTE auditors nationwide and ensure compliance with the Brazilian Inclusion Law and the Convention on the Rights of Persons with Disabilities.
