Brazil prepares decree to regulate bioinputs sector

The Brazilian government is preparing a decree to regulate the Bioinputs Law, aiming to refine product classifications and establish registration procedures for the sector. The draft decree, currently with the Ministry of Agriculture and Livestock, seeks to organize the entire supply chain, including production, import, export, research, and inspection.

Key aspects of the proposal include the classification of bioinputs based on origin, area of operation, and declared function. This allows products to be registered with multiple roles, such as both biological and nutritional functions. The regulation also intends to include inoculants and biofertilizers under the bioinput category.

Regarding registration, the draft proposes an automatic rite for certain product categories, with the exception of those used for phytosanitary control. Simplified registration may be available for microbiological products with previously authorized strains. For new phytosanitary bioinputs, the Ministry of Agriculture must consult Anvisa and Ibama regarding human health and environmental risks, respectively; these consultations will be binding.

The regulatory framework addresses a market that, according to Croplife data, moved R$ 6.2 billion in Brazil in 2025. It will also establish rules for establishments such as manufacturers, importers, distributors, and research institutions, as well as specific requirements for producers manufacturing bioinputs for their own use.
