Brazil proposes triple list for regulatory agency directors

Bill 1219/26, currently under analysis in the Brazilian Chamber of Deputies, proposes new procedures for appointing directors to regulatory agencies. The legislation would require a public pre-selection process to create a triple list of candidates based on curriculum analysis and interviews conducted by a specialized committee. Following this process, the President of the Republic would select names from the list to be submitted for Senate confirmation.

The bill also introduces new grounds for the removal of directors. Mandates could be terminated due to recurrent insufficient performance or unjustified failure to fulfill duties, with the final decision resting with the Senate upon presidential provocation. Other specified reasons for loss of mandate include resignation, conviction for administrative improbity, crimes that prohibit holding public office, disciplinary proceedings, illness-related incapacity, or legal violations.
