Brazil sees faster divorce processes through digital notary services
Divorce processes in Brazil are becoming increasingly rapid and less bureaucratic due to the digitalization of notary offices and current legislation. According to data from the National Council of Justice (CNJ), couples who agree on the dissolution of marriage can complete the process in as little as two business days through extrajudicial means, whereas traditional judicial procedures can take up to two years.
To qualify for an extrajudicial divorce, parties must reach absolute consensus, have no minor or incapacitated children, and be represented by a lawyer. The e-Notariado platform allows for a 100% online process, enabling digital document submission and video conferencing with a notary, which benefits couples living in different states or abroad.
In a related development regarding marital planning, a new online calculator has been developed to help couples choose a property regime. The tool aims to simplify legal complexities by guiding users through questions about assets and financial plans to suggest compatible models, such as partial community property, universal community property, or separation of assets.
