Brazil Senate approves reduction of work week to 40 hours

The Brazilian Senate has approved a constitutional amendment (PEC 221/2019) to end the 6x1 work scale, which mandates six days of work followed by one day of rest. The reform establishes a mandatory two-day weekly rest period and reduces the maximum weekly workload from 44 to 40 hours without any reduction in wages.

The implementation will follow a gradual 14-month transition period. Within 60 days of the amendment's promulgation, companies must adopt a 5x2 scale and a maximum 42-hour work week. After an additional 12 months, the limit will drop to 40 hours.

The measure, supported by President Luiz Inácio Lula da Silva, was passed with 75 votes in favor and one against. While labor unions and supporters highlight the benefits for approximately 22 to 26.8 million workers, industrial groups like the CNI and Fiesp have raised concerns regarding increased production costs, potential inflation, and impacts on national productivity.
