Brazil Senate approves national policy for critical and strategic minerals

The Brazilian Senate has approved the National Policy for Critical and Strategic Minerals (PNMCE), a legislative framework designed to bolster the country’s industrial sovereignty and reduce dependence on foreign technology. The policy focuses on increasing domestic processing and value addition for essential resources, including rare earths, which are vital for the energy transition, electric vehicles, and defense industries.

The plan includes significant financial incentives, totaling up to R$ 7 billion. This includes R$ 5 billion in tax credits intended for companies that process or recycle minerals within Brazil between 2030 and 2034. Additionally, the proposal establishes the Mineral Activity Guarantee Fund (FGAM), a private-natured fund where the Union may contribute up to R$ 2 billion to facilitate credit access for mining projects.

A new governance structure will be implemented, featuring a national council linked to the Presidency of the Republic. This council will be responsible for defining which minerals are considered strategic, with reviews occurring every four years. The legislation also grants the National Mining Agency (ANM) new authorities regarding auction priorities for strategic areas. The project now moves to President Luiz Inácio Lula da Silva for final sanction.
