Brazil Senate approves new rural insurance legal framework

The Brazilian Senate has approved Bill 2.951/2024, a new legal framework for rural insurance designed to enhance protection for agricultural producers against climate instability and budget cuts. The bill, authored by Senator Tereza Cristina, now awaits presidential sanction.

Key provisions of the legislation include making insurance subsidies mandatory within the Ministry of Agriculture and Livestock budget to prevent the blocking or contingency of funds. The bill also establishes rules for using rural insurance as collateral for credit operations, which could lead to lower interest rates for insured producers. Additionally, the framework aims to expedite indemnity payments, proposing a timeline of up to 15 days following a producer's notice in cases where a physical inspection is not required.

Industry entities, including the FAEP System, emphasize that this modernization is urgent to move away from emergency relief models toward predictable, rule-based protection. By linking insurance more closely to credit, the law seeks to reduce default rates for banks and cooperatives while improving the sector's resilience to extreme weather events.
