Brazil Senate considers lowering elderly age for persons with disabilities

A legislative proposal is currently under review in the Brazilian Senate that could redefine the legal status of persons with disabilities. Bill 401/2019 suggests that individuals with disabilities could be considered elderly starting at age 50, rather than the current age of 60 established by the Statute of the Elderly.

Under the proposed law, age alone would not grant this status. Instead, individuals would undergo mandatory medical, psychological, and social evaluations to determine eligibility on a case-by-case basis. The bill has already passed the Chamber of Deputies and relevant Senate committees, but a plenary vote date has not yet been set.

The project originated in 2011 and has undergone several stages of legislative processing. If approved, it would create a specific legal category for this demographic without altering the general age requirement for the rest of the population.
