Brazil Senate President Davi Alcolumbre Receives Letter from Electricity Sector Associations Opposing PL 5.017/2019 Prol
Nine Brazilian electricity sector associations, including ABIAPE, APINE, ABRATE, ABEEÓLICA, ABRACE, ABRACEEL, ABRADEE, ABRAGE and ANACE, sent a letter to Senate President Davi Alcolumbre expressing strong opposition to provisions added to the substitute text of PL 5.017/2019. The original bill dealt with special tariff discounts for semi‑artesian water wells, but the amendment introduced mandatory contracts for 2.5 GW of gas‑fired thermoelectric generation (with at least 70 % inflexibility) and 4.9 GW of small hydropower plants up to 50 MW, as well as requiring ANEEL to hold auctions for gas‑fired generation in the North using Amazonian natural gas.
The associations argue that compulsory procurement bypasses technical planning by the Empresa de Pesquisa Energética (EPE), risking inefficiencies and higher consumer costs. They criticize that the amendments were inserted extraparliamentarily and approved by the Senate Infrastructure Services Committee on 14 July without prior technical debate. Alcolumbre has not yet decided whether to bring the bill directly to a plenary vote or refer it to a thematic commission; a decision is expected after the parliamentary recess beginning 1 August. The bill’s relator is Senator Hermes Klann (PL‑SC).
