Brazil Senate stalls fuel fraud bill PLP 109

The PLP 109/2025 bill, described by the fuel distributors’ union Sindicom as strategic for combating fraud in Brazil’s fuel market, has been approved by the Chamber of Deputies but remains stalled in the Federal Senate. The legislation would grant the Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP) access to electronic tax invoices for fuel sales while preserving fiscal confidentiality, enabling more effective cross‑checking and identification of irregularities throughout the supply chain.

The bill, part of the package responding to the “Operação Carbono Oculto” probe, also requires the ANP to coordinate with the Federal Revenue Service and state tax authorities when sanctioning actions with tax repercussions, and ties the agency’s licensing powers to compliance with the new data‑access rules. Sindicom’s executive director Mozart Rodrigues called the measure “essential to qualify the fight against fuel‑market fraud.” The proposal is awaiting the appointment of a Senate rapporteur and a Senate‑plenary vote on an urgency request.
