Justice Marco Buzzi faces sexual harassment probe as MPF rejects erectile dysfunction claim

Brazil's Federal Public Ministry (MPF) argued that a urological report indicating moderate sexual dysfunction does not eliminate the possibility that Supreme Court of Justice (STJ) Justice Marco Buzzi committed sexual harassment. The MPF’s statement, attached to the disciplinary administrative process, rejected the defense’s claim that the magistrate’s health condition made the alleged conduct impossible.

The investigation concerns two women: an 18‑year‑old who said Buzzi assaulted her during a beach swim at Estaleiro Beach in Balneário Camboriú in January, and a former third‑party staff member who reported non‑consensual touching and sexual comments between 2023 and 2025. Buzzi has been suspended since February. The MPF requested that the case be concluded by mid‑August, before the new STJ leadership takes office on 19 August, and asked that the judge receive a compulsory retirement with proportional benefits.

Buzzi’s defense presented medical assessments citing erectile dysfunction, leg length discrepancy and balance issues, arguing that these limitations would preclude the alleged actions. A consulting physician testified that, while the conditions affect physical capacity, they do not make the alleged conduct impossible. The MPF maintained that the evidence supports charges of importunation, sexual harassment and injury to judicial decorum.
