Brazil Supreme Court and Federal Courts Resume Sessions, Set to Hear Major Labor and Tax Cases

The July judicial recess in Brazil ended on Friday, 31 July, and the Supreme Court (STF), Superior Court of Justice (STJ), the Federal Regional Court of the 5th Region (TRF5) and the Labor Regional Court of the 7th Region (TRT7) resumed hearings on Monday, 3 August. The courts have packed calendars, with the STF and STJ opening the second half‑year session and the TRF5 holding a virtual plenary on 5 August. The agenda includes 14 high‑risk fiscal actions amounting to roughly R$534.6 billion, and the STF will consider ending the “vote of quality” in the CARF on 26 August.

In the same session, the STF is slated to decide on several high‑profile labor and social‑security matters. On 27 August, ministers will hear the “uberization” case to determine whether platform drivers are employees, alongside a related case involving app delivery workers. The Court will also review the Funrural fund issue, which concerns contributions of up to R$17.2 billion and the possibility of sub‑rogation by purchasers of rural production. These decisions are expected to have significant fiscal and employment implications across Brazil.
