Brazil: Legal developments in Henry Borel and Unha e Carne cases

In the Henry Borel case, a Rio de Janeiro judge has ordered the defense of former councilman Jairo Souza Santos Júnior, known as Jairinho, to present arguments for their appeal. Jairinho was sentenced to 43 years, 9 months, and 20 days in prison for the 2021 death of 4-year-old Henry Borel, with charges including qualified homicide, torture, and coercion. Monique Medeiros, the child's mother, was convicted of torture by omission, though the Public Ministry is appealing her acquittal regarding intentional homicide.

In separate legal proceedings, Supreme Court Justice Alexandre de Moraes authorized the release of federal judge Macário Ramos Júdice Neto, replacing his preventive detention with precautionary measures including an electronic ankle monitor and passport seizure. Júdice Neto is investigated for allegedly leaking confidential information regarding Operation Unha e Carne, which targeted TH Joias and suspected links to the Comando Vermelho criminal faction.

Moraes also authorized the transfer of Rodrigo Bacellar, former president of the Rio de Janeiro Legislative Assembly, from a federal penitentiary in Mossoró to a prison unit in Rio de Janeiro. Bacellar remains in preventive detention. Additionally, Moraes ruled that the “coup draft” found at the home of former minister Anderson Torres must be kept by the Federal Police as evidence, while ordering the destruction of weapons and ammunition seized from Torres and two former PMDF colonels.
