STF President Fachin redistributes INSS probe to Mendonça

Edson Fachin, President of the Brazilian Supreme Federal Court (STF), has returned the leadership of the INSS fraud investigation, known as Operação Sem Desconto, to Minister André Mendonça. The probe investigates unauthorized deductions from retirement and pension benefits. Fachin determined there is no longer a justification to keep the case under the Presidency following a report from the Prosecutor General’s Office, which found no evidence of abuse of authority by Mendonça.

In a separate decision, Fachin will maintain temporary control over the Banco Master investigation, known as Operação Compliance Zero, for a period of 90 days starting from September 12. This case involves allegations regarding the relationship between banker Daniel Vorcaro and Supreme Court members, including Alexandre de Moraes. Fachin justified the continued oversight due to the involvement of court members in the investigation.

The decisions have highlighted internal tensions within the STF. While Mendonça’s allies support the return of the INSS case, allies of Alexandre de Moraes have expressed dissatisfaction, advocating for the immediate redistribution of the Banco Master case. Minister Gilmar Mendes suggested that the Banco Master investigation should be moved to the STF plenary to ensure impartiality, citing potential conflicts of interest within the First Chamber.
