Brazil Supreme Court ends INSS 'revisão da vida toda' pension review

On 9 July 2026 the Brazilian Supreme Court (STF) certified the transit in julgado of the long‑running “revisão da vida toda” case concerning the Instituto Nacional do Seguro Social (INSS). In a 7‑3 vote the Court rejected the final appeal filed by the Confederação Nacional dos Trabalhadores Metalúrgicos (CNTM), confirming that retirees cannot include contributions made before July 1994 in the calculation of their pensions.

The ruling makes the decision final and unappealable, sending the matter back to lower courts for compliance. It also confirms earlier STF determinations that benefits paid before 5 April 2024 will not be reclaimed and that no court costs or attorney fees may be charged for those actions. The decision overturns a December 2022 STF position that had briefly allowed the revision, a stance the Court abandoned in April 2024 during a separate factor‑previdenciário case.

By ending the possibility of retroactive benefit increases, the Court averts an estimated fiscal impact of up to R$ 480 billion on the federal budget. The majority opinion was authored by Justice Kassio Nunes Marques and supported by Justices Alexandre de Moraes, Cármen Lúcia, Cristiano Zanin, Gilmar Mendes, Flávio Dino and Luiz Fux; Justices Dias Toffoli, Edson Fachin and André Mendonça dissented. The INSS will now process pending cases under the new legal framework, and retirees will not receive higher payouts based on the rejected calculation method.
