Brazil Supreme Court excludes ICMS credits from PIS and Cofins tax base

The Brazilian Supreme Federal Court (STF) has ruled that presumed ICMS tax credits cannot be included in the calculation base for PIS and Cofins taxes. In a decision with general repercussion (Theme 843), the court determined that these credits, which are state-granted tax incentives, do not constitute revenue or turnover for companies.

The ruling follows a long-standing dispute where the Union argued these credits should be taxable. However, the majority of the court found that these values represent tax waivers intended to incentivize economic activity rather than new wealth or economic availability for the companies.

Following the decision, companies are moving quickly to seek the recovery of amounts paid over the last five years. The Federal Revenue Service estimates that this victory for taxpayers could cost the Union up to R$ 16.5 billion. Legal experts suggest businesses must act promptly before the court potentially implements modulation rules that could restrict the retroactive effects of the decision.
