Brazil: STF expands vehicle tax exemptions and INSS faces rising benefit denials

Brazil's Supreme Federal Court (STF) has ruled that tax exemptions for vehicle purchases cannot be restricted to individuals with moderate or severe disabilities. This decision expands benefits to include those with mild mental disabilities and individuals with level 1 Autism Spectrum Disorder (ASD), facilitating mobility and independence for approximately 12,600 people. Minister Alexandre de Moraes noted that the ruling requires individualized analysis to prevent discrimination and stated it would not negatively impact fiscal revenue or the automotive sector.

Regarding social security, the National Institute of Social Security (INSS) has seen a 70% increase in denied benefit requests in 2026 compared to 2025. While the waiting list for benefits dropped from 2.6 million to 1.55 million due to the 'Acelera INSS' program, the rate of denials has risen significantly. In response, Bill 2795/26 has been proposed in the Chamber of Deputies, which would require the INSS to pay double the owed amounts to citizens if a benefit is denied due to material error or insufficient document analysis.

Additionally, the INSS has updated its list of 18 specific diseases and conditions—including cancer, Parkinson's, and high-risk pregnancy—that allow for disability benefits without the standard 12-month contribution requirement. For those receiving benefits, the 13th salary for new beneficiaries will be paid between November 24 and December 7, 2026.
