Brazil's STF rules on SUS payments and judicial deposits

The Brazilian Supreme Federal Court (STF) is managing several high-stakes legal developments. A majority of ministers has formed to decide on the constitutionality of SUS Table payments to private hospitals, a dispute that could impact R$ 24 billion in the public budget.

In a separate ruling, the STF decided by 7 to 2 that banks are not required to include inflationary gaps in the monetary correction of judicial deposits, reversing a 2017 Superior Court of Justice (STJ) precedent. This decision affects thousands of lawsuits regarding economic plans from the 1980s and 1990s.

Additionally, STF President Edson Fachin has requested a detailed, technical report from the Federal Police regarding mentions of several ministers—including Dias Toffoli, Alexandre de Moraes, Luiz Fux, and Kassio Nunes Marques—within investigations related to Banco Master. The court aims to clarify these references to mitigate political pressure and potential impeachment proceedings in the Senate following the 2026 elections.
