Brazil Supreme Court rejects pension full‑lifetime review

On 21 June 2026 the Brazilian Supreme Court (STF) voted 7‑3 to dismiss the so‑called “revisão da vida toda,” a claim that would let retirees of the Instituto Nacional do Seguro Social (INSS) recalculate benefits using contributions made before July 1994. The majority argued the change could create a fiscal gap of about R$ 480 billion. The court ruled that even retirees who had previously won cases based on earlier jurisprudence will not receive the additional correction, although those whose decisions were final before 5 April 2024 can keep amounts already paid. Lawyer Marcella Moreira Barbosa Hunas explained, “After the STF’s change in understanding, the main discussion now concerns legal certainty and the maintenance of rights for insured persons who filed before the shift.” The decision ends a long‑running legal battle over pension adjustments.
